YouTube Videos

The copyrights to any and all games uploaded by Pikakid98 Studios or Pikakid98 (regardless if they are on Steam or an official third party account owned by Pikakid98) state that you may freely record, upload and monetize videos of our games. We love to see what people make. Please be aware that if your video is removed due to containing racist or offensive content then this is the responsibility of YouTube unless the content pertains to us personally

Example:

"The developers of this game went to a group of black people and said horrible things. So report this developer for being offensive"

Then we may take legal action. Please be aware that simply using footage from our games or uploading music tracks is not a violation of our copyrights as long as you give credit and don't claim that the content in the games or music etc. is yours.

Example:

"Here's a game/song I made"

Unless the content itself is a remix or fan game then this section does not apply.

Pikakid98 Studios' Games

Any and all games made by Pikakid98 Studios or any subsidiaries are also copyrighted in the way that you may not steal files and use them as your own. Doing so is a violation of the Pikakid98 Studios terms of service. If one of our games is being sold under another company or assets made by us are being resold under another name then this is a violation of our terms of service. We have nothing against free games based on our game on sites like Gamejolt or Itch.io but as long as they are non-profit and state that they are fan projects. We do not allow monetisation of fan content based on our characters or games via ad revenue or donations (unless you’re asking for donations in general and not just for your fan project). As for any free games, We currently only support Gamejolt and itch.io (See this page for official accounts). Any accounts claiming to be us for whatever reason should be ignored or reported.

Modding (Modifying Games/Software)

Our laws on modding are that you must not attempt to sell any mods or even if you are offering a full and free modded version of our game/software without any permission or knowledge from Pikakid98 Studios then it must be free and must not include the full game/software but only the files you have modified. Many sites allow you to upload mods. Please be aware of downloading viruses though. Always scan mods and don’t trust installers that claim to mod our game. Do NOT offer payed mods. Please note that some of our games and software will explicitly state that you may not mod them and we have the right to enforce this.

The only site we officially sell our games/software on is Valve’s Steam. If another vendor is selling our games/software outside of Steam then we unfortunately cannot do anything about this. We implore you to only buy Pikakid98 Studios’ games/software from Steam only. We are not responsible for anything that happens to you from using stolen or pirated keys. Some sites (Which we won’t name names.. We’ve learned from last time) may potentially sell stolen or pirated keys or potentially even blatant viruses. Please note that we have nothing to do with any of these sites unless explicitly stated on our social media accounts.

Video Redistribution

As for YouTube videos from Pikakid98, You may not reupload unless explicit permission is given. We have noticed an influx of sites claiming to be official uploads of my (Pikakid98) content and they place ads on their site which i get no money from. Please avoid these pirated video domains. Please only watch Pikakid98 videos from the Official Sources

Pikakid98 Studios General

You agree to not steal any Pikakid98 Studio or Pikakid98 owned website. You may share our websites (If you want to show off our work) but you may not use any assets we use and claim them as your own. The logo of Pikakid98 Studios and Pika Twilight is copyrighted. If you see any accounts going by these names and pretending to be us (Offering game/software keys, Linking to sites) they are not us. The official accounts of Pikakid98 Studios can be found in our About section or on Pikakid98's YouTube Channel Section. Please also note that if an account claiming to be one of us personally tries to trick you with potential viruses, fake keys etc. contact us as soon as possible. Our team accounts are linked officially under the Team section. If for any reason you trusted one of these fake accounts then we do not take responsibility for what happens to any of your accounts, information or computer as we were not the distributors of the harmful content.

Pikakid98 Studios Privacy

Any data that we may or may not collect from either our games/software, apps or emails sent to us will not be shared or sold for profit. We are very big on privacy. If any of our games or apps collect information, We are legally obligated to state just what information is collected and for what purpose. Once again, any of this data will only be used to improve our services and not for profit. If however you do not like data collection we will add an option to opt out right at your first time boot up and will never ask for data collection ever again. Please be aware that if your country has a law that disallows data collection of people under a certain age then you MUST opt out of data collection. if you opt in and you are underage then we are not responsible for your actions.

Please be aware that Pikakid98 Studios is a British company. Therefore we follow British laws.

EULA (End User License Agreement)

Our EULAs (or End User License Agreements) must legally state anything that we want to do. However our EULAs will NEVER ask you for the following (banking information, passwords, phone numbers, full names or house address) any exceptions may include (email addresses (which may be for a Pikakid98 Studios account if we decide to do that) and IP addresses (which may be used for online functionality)). None of this information is to be sold and will be kept as safe as possible. Please be smart with the information you give. Please also note if anyone contacts you claiming to be us asking for any of this info due to “a change of the EULA” then check this section. Any changes will be explicity stated.

As stated previously, you are free to record our games/software/apps and monetise them. If someone has claimed them claiming to be us or claiming on behalf of us then they are false claims. If you record a game featuring an OST (Original Soundtrack) and a supposed record label claims it either in our name, on behalf of us or as a different artist all together then they are false. If you show assets from our video games

Top 10 easter eggs in {Name of game}

and someone claims to own the assets or once again, claiming on behalf of us then these are also false.

Mods

If for whatever reason someone gives you a DMCA on a mod for a game, app or software we have stated that modding is ALLOWED then this is false. If you own or manage a modding site for mods of games, app or software (not just from us) and someone claiming to be us is threatening to sue you for content we have allowed then this is false.

Fan Games

While it may seen stupid to imagine fan games there may be at least one or two based on characters by us. This is allowed under our terms and conditions. If someone claims to own the game or a specific word in the game and are suing YOU for simply creating and hosting the game on either a site like Gamejolt, Itch.io etc. or even on your own domain then this is false. If someone contacts you asking you to take down your fan game due to copyright violations due to using the original title

The original is called "Epic Adveture" and you make a fan game/ fan album called "Epic Adventure: More Epicness"

please contact us Here and we will try and sort it out as this.. surprise surprise.. is also.. false. If someone claims to BE the character in the game asking for money for using them in your fan game... well.. I don't think I need to say anymore... because of course, fictional characters cannot sue real people.. so this too.. is false.
